Terms of Service
These Terms of Service (the "Terms") set out the conditions for using Mute My Devil (the "Service") provided by Garland Inc. (the "Company"). Please read these Terms carefully before using the Service.
1. Application
These Terms apply to all relationships between users and the Company arising from use of the Service. The Company may set out additional rules and provisions regarding the Service ("Individual Provisions"). Regardless of their name, such Individual Provisions form part of these Terms.
2. Registration
Registration is completed when an applicant agrees to these Terms, applies in the manner prescribed by the Company, and the Company approves the application. The Company may decline an application if it determines there is cause to do so, and bears no obligation to disclose the reason.
3. Management of Credentials
Users are responsible for properly managing the email address and authentication credentials used to log in to the Service. Users may not, under any circumstances, transfer, lend, or share their credentials with third parties.
4. Fees and Payment
Users shall pay the fees for paid portions of the Service, as separately determined and displayed by the Company on this website, by the method designated by the Company. If a user delays payment, the user shall pay late charges at an annual rate of 14.6%.
5. Prohibited Conduct
When using the Service, users must not engage in: conduct that violates laws or public order and morals; conduct related to criminal acts; unauthorized copying or altering of the Service; conduct that destroys or interferes with the Company's servers or network; conduct that may interfere with the operation of the Service; collecting or storing other users' personal information; unauthorized access or attempts thereof; impersonating other users; or any other conduct the Company deems inappropriate.
6. Suspension of the Service
The Company may suspend or interrupt all or part of the Service without prior notice if it determines that: maintenance or updates to the Service's computer systems are required; provision of the Service has become difficult due to force majeure such as earthquake, lightning, fire, power outage, or natural disaster; or the Company otherwise determines that provision of the Service is difficult.
7. Restriction and Deletion of Registration
The Company may, without prior notice, restrict all or part of a user's use of the Service or delete the user's registration if the user violates any provision of these Terms, or if the Company otherwise determines that continued registration is inappropriate.
8. Withdrawal
Users may withdraw from the Service through the procedure prescribed by the Company.
9. Disclaimer of Warranties
The Company does not warrant, expressly or impliedly, that the Service is free from factual or legal defects. The Company bears no liability for any damages incurred by users arising from the Service. However, this disclaimer does not apply where the contract between the Company and the user constitutes a consumer contract under the Consumer Contract Act.
10. Changes to the Service
The Company may change the content of the Service or discontinue its provision without notice to users, and bears no liability for any damages incurred by users as a result.
11. Changes to These Terms
The Company may change these Terms at any time without notice to users when it deems necessary. If a user begins using the Service after a change to these Terms, the user is deemed to have agreed to the revised Terms.
12. Handling of Personal Information
The Company shall properly handle personal information obtained through use of the Service in accordance with its Privacy Policy.
13. Notices and Communications
Notices or communications between users and the Company shall be made in the manner prescribed by the Company. Unless a user submits a change in the prescribed manner, the Company treats the currently registered contact details as valid and sends notices there, which are deemed to have reached the user at the time of dispatch.
14. Prohibition of Assignment
Users may not assign, or provide as security to a third party, their contractual status or any rights or obligations under these Terms without the Company's prior written consent.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. In the event of a dispute regarding the Service, the court with jurisdiction over the location of the Company's head office shall have exclusive agreed jurisdiction.
16. Email Notifications
The Company sends authentication codes and links for login and identity verification, and other communications necessary to provide the Service, to the user's registered email address. Users are responsible for keeping their registered email address current and able to receive mail. The Company bears no liability for non-delivery or delay caused by issues on the mail delivery path, filtering by mail providers, the user's mail client settings, or other causes beyond the Company's reasonable control. Important communications related to the Service (changes to the Terms, identity verification, security notices, fee and contract notices, etc.) may continue to be sent to the registered email address.
17. User Content and "Tonight's Sky"
Words a user records in the "unsent room" are never sent or delivered to the person they are addressed to, and are not disclosed to other users without the user's explicit consent. The Company may use an external AI service to check content and to provide analysis to the user. Only words for which the user has explicitly consented to anonymous publication in "Tonight's Sky" may, after AI content review (moderation), be shown to other users as an anonymous excerpt. The Company may replace information that could identify a specific individual with masking characters, and may decline to publish words it deems inappropriate by its standards (threats toward others, sexual or promotional content, content suggesting self-harm, etc.). Users must not post content that infringes the personal information or reputation of third parties, or that otherwise violates laws or public order and morals. The Company makes the final decision on whether and how content is published, and bears no liability in this regard.
